They had a former Board member doing reserve studies, claiming 100% funded every year. I dug into it and concluded it was %. Hired an expert to confirm. They then claim the 100% funded really meant 100€% funded for projects for the current fiscal year. They actually sent out altered CA Civil Code Form 5570 in order to hide the truth. I bought in on the premise of 100% funded. Disaster. Lawsuit. That omission is the lack of a subsurface drainage system to allow subsurface water to drain out. It does appear that the building was built out of sequence for the waterproofing of the decks and that improper flashing/and/or lack of a door pan contributed to the failure. The deck was flat too and the sub appears to have waterproofed the deck with pre-sloping first. <br /><br />There are a three parties who have some culpability in my opinion. Actual Reserve Studies rarely are anything more than guesstimates, and overly conservative at that, of what actual costs to repair or replace will be. Further the Studies make the unreasonable assumption that all expense for, say reroofing, will be done at one time rather than over two or more years. This tends to place an unreasonable burden on the assessment process for that component. This also tends to put pressure on Boards to select cheaper repairs and actually gives HOA owners less than their best value for their money. The Reserve Study process should be dramatically analyzed by all Board members before we stick homeowners with additional assessment increases for things that actual costs and better managed repairs can avoid. We bought a condo in Northern Virginia, and the board was packed by investors who wanted low condo fees, to boost condo prices. The investors sold out, leaving the condo owners with no reserves and a laundry list of repairs (leaking roofs, rotting pipes, etc.) to be made.<br /><br />Special Assessments were levied - on the order of $10,000 per unit, on more than one occasion. Those were some fun condo meetings to go to. People were weeping.<br /><br />We bought two vacation condos in Florida and the same thing happened. The developer kept the condo fee low, in violation of Florida State Law that set forth amounts to be kept in reserve. Most condos in Florida are probably in violation of that law. Again, without reserves, repairs had to be made by special assessment, which was popular with no one.<br /><br />We even had a house on a private road, which is like a road condo.
